This End User License Agreement ("Agreement") is a binding contract between you ("you") and MFSoft LLC ("MFSoft," "we," "us") governing your use of the MFCommander application and its updates, documentation, and bundled components (together, the "Software").
By installing, activating, or using the Software you accept this Agreement. If you do not accept it, do not install or use the Software, and — if you have paid — request a refund under our Refund Policy.
If you are accepting on behalf of a company or other organization, you represent that you have authority to bind it, and "you" means that organization.
The Software is licensed, not sold. MFSoft and its suppliers retain all right, title, and interest in the Software, including all intellectual property rights. You receive only the rights this Agreement grants.
MFCommander ships in three editions:

Subject to your compliance with this Agreement and payment of any applicable fees, MFSoft grants you a non-exclusive, non-transferable, non-sublicensable license to install and run the Software on Macs that you own or control, for the edition you have activated.
Community is licensed free of charge with no time limit.
Pro and Infrastructure are one-time purchases that grant a perpetual license to the versions of the Software released during your updates window — twelve (12) months from the date of purchase, unless your license key states otherwise. Concretely:
Licenses are issued to a named individual for use on that individual's own machines. A license is not a floating or concurrent-use seat, and it may not be shared across an organization except under a separate written volume agreement with MFSoft.
On first launch without a license, the Software unlocks every feature — including the Pro connectors and the Kubernetes and Docker browsers — for a 14-day evaluation period. No payment details are required to start a trial.
When the trial ends, the Software reverts to Community features. Your settings, saved connections, tabs, and paths are preserved. Access to local files is never withdrawn.
The trial is offered once per user. Circumventing the trial period — for example by tampering with your system clock or removing the Software's trial markers to restart it — is a breach of this Agreement.

Activation is offline. Your license key is a cryptographically signed token. The Software verifies it locally against a public key built into the application. Activation requires no account, no registration, and no network connection.
Validation is periodic and online. After activation, the Software contacts api.mfsoft.dev from time to time to confirm the license is still in good standing:
Validation fails open. If you are offline, if the check times out, if our server is unreachable, or if the response cannot be verified, nothing happens — your edition is unaffected. The Software is fully usable offline for as long as you like.
The only thing that downgrades a paid license is a cryptographically signed confirmation from MFSoft that your license was refunded, charged back, or revoked. In that case the Software resolves to Community features. Your saved connections, settings, tabs, and paths are preserved and your local files remain fully accessible.
We may change the validation cadence in future versions. We will not add file, connector, or usage data to what is transmitted without updating the Privacy Policy and saying so in the release notes.
Usage statistics are separate from license validation. By default, the Software sends a privacy-minimized daily summary of application and feature use to a separate endpoint. You may switch this off at any time in Settings › Privacy, and the Software provides a view of the exact next report. The Privacy Policy describes the fields, exclusions, purpose, legal basis, retention, and deletion controls. Usage statistics never include files, paths, searches, connection details, credentials, license keys, license IDs, customer details, hardware identifiers, or free-form text.
The Software may check for new versions and install them if you enable updates. Update checks send only your application version and platform. They do not send your license key, license ID, entitlement status, device identifier, file names, connector metadata, or any application data. You can disable update checks in Settings at any time.
You may not:
The Software bundles third-party libraries under their own licenses. Those licenses govern those components, and nothing in this Agreement — including Section 6 — limits any right you have under them. Where a component's license conflicts with this Agreement, the component's license controls for that component.
MFCommander dynamically links libsmb2 (via the AMSMB2 wrapper) and libnfs, each under the GNU Lesser General Public License version 2.1. As the LGPL requires, these ship as separate .dylib files inside the application bundle and you may replace them with your own compatible builds. The application is signed with the library-validation exemption specifically so a library you built yourself will load.

MFCommander connects directly from your Mac to the servers, buckets, containers, and clusters you configure. MFSoft does not proxy, relay, intercept, or store that traffic, and never receives your files or your credentials. Credentials are stored on your device — in the macOS Keychain where the connector supports it.
You are responsible for your own use of the Software, for having authorization to access the systems you connect to, and for complying with the law and with any agreements governing those systems.
Purchases are processed by Polar Software Inc., our Merchant of Record. Polar is the seller of record for your transaction: it takes payment, calculates and remits sales tax and VAT, and issues your invoice. Your purchase is also subject to Polar's own terms.
Refunds are governed by our Refund Policy: 14 days, no questions asked, without prejudice to any mandatory statutory right you have under consumer protection law where you live.
This Agreement runs until terminated.
It terminates automatically if you materially breach it and do not cure the breach within 30 days of notice from us. We may also terminate a license obtained by fraud, or one whose payment was reversed. You may terminate at any time by uninstalling the Software and destroying your keys.
On termination you must stop using the Software and delete your license keys. Sections 1, 6, 7, 11, 12, 13, 14, and 15 survive.
The Software is provided "as is" and "as available," without warranty of any kind. To the maximum extent permitted by law, MFSoft disclaims all warranties, express, implied, or statutory, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.
MFSoft does not warrant that the Software will be uninterrupted, error-free, or free of harmful components, or that it will meet your requirements.
MFCommander copies, moves, and deletes files, and can act on live infrastructure. You are responsible for maintaining backups. Do not rely on the Software as your only copy of anything you cannot afford to lose.
If you are a consumer, some jurisdictions do not allow the exclusion of implied warranties or statutory guarantees. Where that is the case, this Section applies only to the extent permitted, and nothing here limits rights you cannot waive by contract.
To the maximum extent permitted by law, MFSoft will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or the cost of substitute goods — whether in contract, tort, or any other theory, and even if we were advised such damages were possible.
MFSoft's total aggregate liability under this Agreement will not exceed the greater of (a) the amount you actually paid for your license in the 12 months before the claim arose, or (b) fifty U.S. dollars (US$50).
Nothing in this Agreement excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. If you are a consumer, these limits apply only to the extent permitted by the consumer law that applies to you.
You represent that you are not located in, and will not use the Software in, a country subject to a U.S. government embargo, and that you are not on any U.S. government restricted-party list. You agree to comply with all applicable export and re-export control laws.
The Software is "commercial computer software" as defined in FAR 12.212 and DFARS 227.7202. U.S. Government end users acquire only the rights in this Agreement.
This Agreement is governed by the laws of the State of New Jersey, United States, where MFSoft LLC is organized, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
The state courts of New Jersey and the United States District Court for the District of New Jersey have exclusive jurisdiction, and you consent to venue there — except that if you are a consumer, you may bring proceedings in the courts of your country of residence, and mandatory consumer-protection law there continues to apply to you regardless of this Section.
Entire agreement. This Agreement, together with the Refund Policy and Privacy Policy, is the entire agreement between us about the Software, and supersedes any prior understanding. Our Website Terms of Service separately govern your use of mfsoft.dev.
Changes. We may update this Agreement for future versions of the Software. Changes apply to versions released after the change; they do not retroactively alter the terms under which you licensed a version you already have. Material changes will be noted in the release notes and by an updated effective date.
Assignment. You may not assign this Agreement. We may assign it in connection with a merger, acquisition, or sale of assets, on notice to you.
Severability and waiver. If a provision is unenforceable, it is modified to the minimum extent necessary and the rest stays in force. A failure to enforce a provision is not a waiver of it.
